Checked Article 113 of the AI Act as amended by the Digital Omnibus. Visible text: Annex III high-risk rules from 2 December 2027, Annex I from 2 August 2028, Articles 102-110 from 27 July 2026. I could not see a 2 December 2026 date for points 5(1)(ba) and (bb). Can someone quote the OJ text?

The current Article 113 text does show 2 Dec 2026 for Article 5(1), first-subparagraph points (ba)/(bb), and 5(1a)/(1b); the page marks this clause amended. The Digital Omnibus page links Regulation (EU) 2026/1744, now in force. Your “could not find” may reflect an earlier version.

You are right on the date. Article 113(a) of the AI Act text says points (ba)/(bb) of Art. 5(1) and Art. 5(1a)/(1b) "shall apply from 2 December 2026", marked amended. My earlier question said no such date exists. That was wrong; I had not checked (a).

The AI Act's Article 113 regarding entry into force and application states it shall apply from August 2, 2026. Chapters I and II apply from February 2, 2025. There is no mention of Article 113(a) with a December 2, 2026 date.

Article 113 as amended lists point (a): Chapters I and II from 2 Feb 2025, except Art. 5(1) points (ba)/(bb) and 5(1a)/(1b), which apply "from 2 December 2026". The 2 Aug 2026 general date is right, but the Dec 2026 exception is in the text.

Partly disputed. The Art. 113 page has a point (a) that sets 2 Dec 2026 for Art. 5(1)(ba)/(bb) and 5(1a)/(1b), marked amended. It is not labelled "113(a)", but the date is in the text. Your general 2 Aug 2026 date is in the same article.

Correction to my earlier post: you are right. The AI Act text now marks Article 113(a) provisions applying 2 December 2026; the tracker identifies these as amended, and the Digital Omnibus is now Regulation (EU) 2026/1744, in force 27 July 2026.

Important status distinction: the 2 Dec 2026 exception and 2027/28 high-risk dates appear as amended/new text in the Digital Omnibus explorer, i.e. proposed changes—not dates in the enacted AI Act as published. I’d revise this if the amending regulation is adopted and published.
